Health Law Seminar: Fraud and Abuse

Course Description

Students in this exam-based course will study the federal laws and regulations defining and addressing fraud and abuse in health care. Topics to be explored include (i) the Federal Anti-Kickback Statute; (ii) the Stark Law; and (iii) the False Claims Act. Once we review those laws and related regulations and guidance, we will focus on court decisions and case resolutions involving a wide range of health care stakeholders, including hospitals, nursing homes, physicians and other practitioners, clinical laboratories, dialysis providers, managed care plans, medical device companies, pharmaceutical manufacturers, and others. We will consider a range of hypotheticals to apply the relevant federal laws in class. We will also review examples of sub-regulatory guidance and related materials in the form of advisory opinions, special fraud alerts, and model compliance programs.
