Private Property and the Public Good

Course Description

In this course students will explore the tension between private property rights and the common good through the lens of legal theory and public policy. Students will study major theories of common, private, or other forms of ownership, and then apply the theories to various contemporary issues such as housing, environmental preservation, and public health. They will also review constitutional law and case law from both the U.S. and other countries to illustrate alternative approaches to mediating rights, even within the private property tradition. Students will write a paper applying the course material to a modern challenge of their choosing related to property law. They also will present their paper to the class and field audience questions.
